On appeals by the employer and employee against the decision of the employment tribunal, the Employment Appeal Tribunal ruled, inter alia, that, on the facts of the instant case, s87(1) of the had been disapplied by s87(4) and as such there was no requirement for the employer to pay the employee during the notice period.
