Court: Employment Appeal Tribunal

Ellias J, Mr C Edwards and Mr A Manners

Judgment Dates: 14 November 2002

Employment - Unfair dismissal - Investigation of misconduct - Reasonableness of investigation.

The Case

On account of delays, the failure to provide certain statements and the fact that no statements were taken from certain witnesses, an employment tribunal had erred in law in concluding that an investigation into allegations made against a residential social worker concerning a child resident had been reasonable in the circumstances. Accordingly, the employee's dismissal had been unfair.
