Contract - Licence - Agreement to transfer licence - Claimant agreeing to obtain licence for base in Americas Cup Village - Claimant agreeing to transfer licence to defendants - Claimant contending defendant agreeing to reimburse claimant for sums expended by it pursuant to licence prior to its transfer - Whether defendants liable.
The court held that the defendant was liable to the claimant in respect of all sums expended by the claimant for a licence which it had obtained for a base at the Americas Cup village and later transferred to the defendant, since, on the evidence, the defendants had agreed to reimburse the claimant.
