The Case

The defences to the liquidator's claim for recovery from the respondent directors of sums alleged to have been received by them as loans from the company had no real prospect of success. The court therefore gave summary judgment in favour of the liquidator for the payment of the sums of 731,996 and 80,609 by the respondents.
