Pleading - Amendment - New cause of action - Proceedings arising out of alleged breach of contract by the defendant authority - Claimant seeking to amend pleading to include additional claim - Whether amendment to be allowed - s 106.
On an application by the claimants to amend the claim to plead an additional cause of action against the defendant authority, the court directed that the additional claim should be the subject of new proceedings, to be heard at the same time as the existing action.
