An appeal against the employment tribunal's finding of unlawful discrimination on racial grounds on the part of the employer was allowed and the matter remitted for rehearing and re-determination of all material issues on the complaint that the imposition of the more severe penalty of dismissal rather than a reduction in grade by the original disciplinary panel amounted to unlawful discrimination.
