European Community - Failure of a member state to fulfil obligations - Obligations under treaty - Commission sending reasoned opinion to Ireland requesting compliance - Ireland requesting extension of time - Whether Ireland failing to fulfil obligations - EC Treaty, arts 226, 228(7) (now, after amendment, art 300(7) EC).
On the application by the Commission of the European Communities under art226 of the EC Treaty, the Court of Justice of the European Communities declared that Ireland had failed to fulfil its obligations under art 228(7) of the EC Treaty (now art300(7) EC) to obtain its adherence, before 1 January 1995, to the Berne Convention for the Protection of Literary and Artistic Works.
