An appeal by the appellant bricklayers raising the question as to how a 'worker' was to be identified under the Working Time Regulations 1998 was remitted to a fresh tribunal because the employment tribunal hearing the matter had failed to address clearly the appropriate issues and failed adequately to express the reasons why it came to the conclusion it did.
