Judge Rich QC sitting as a judge of the High Court
||22 July 2002
Practice - Chancery Division - Stay of proceedings - Defendant seeking stay of proceedings to apply to Lands Tribunal - Master refusing application for stay - Whether master erring - s 84(9).
The question of whether or not a stay should be granted to allow an application to the Lands Tribunal had to have as its starting point the assumption that normally such a stay would be granted if the application was made timeously.
