Pleading - Amendment - Appeal - Appeal against grant of permission to amend on grounds evidence in support of application to amend fraudulent - Whether appropriate to determine fraud and credibility issue at interlocutory stage.
On an application to set aside an order of the master by which the claimant was granted permission to amend the writ and statement of claim in the action, the court ruled that it was appropriate to adjourn the application to be heard at the same time as the trial of the action.
