An employment tribunal had erred in law in deciding that Sch16 to the School Standards Framework Act 1998 did not apply where an employee was employed by a local education authority and the matter was remitted for them to decide whether the correct procedure contained in that Schedule had been adopted with regard to the employee who had claimed unfair dismissal.
