Costs - Security for costs - Application for summary judgment - District judge making no order save for the claimant to pay security for costs - Whether district judge having jurisdiction to make order - Approach to be adopted by courts when making such orders - CPR PD 24, para 5, CPR rr 1.3, 3.1.
On an application for summary judgment, there was jurisdiction under the Civil Proceedings Rules to make orders which were tantamount to orders for security of costs outside the provisions of CPRPt25. Rules 1.3, 3.1 and CPRPD24 admitted of no other possible conclusion.
