Court: Employment Appeal Tribunal

Recorder Langstaff QC, Mr A Manners and Mr S Springer

Judgment Dates: 24 July 2002

Unfair dismissal - Determination whether dismissal fair or unfair - Reason for dismissal shown by employer - Employer dismissing employee following misconduct - Employment tribunal deciding employer acting unreasonably - Whether tribunal erring in law.

The Case

The employer's appeal against an employment tribunal's decision that its dismissal of the employee was unreasonable was allowed on the ground that the tribunal might, and probably did substitute its own view of the rights and wrongs of the dismissal for that of the employer.
