Sentencing - Theft - Burglary - Release dates - Judge intending defendant to be released by particular date - Result of sentences passed being that defendant would not have been released by that date - Whether sentences in breach of judge's intention.
On the facts of the instant case, where the judge had indicated he had intended that the defendant should be released by a particular date, but the result of the sentences passed was that the defendant would not have been released by that date, the Court of Appeal would reduce the defendant's sentences to give effect to the judge's intention.
