Contract - Construction - Term - Extent of work included in tender price - Whether claimant entitled to recover for additional work - Whether claimant entitled to recover for prolongation of contract - Whether defendant entitled to recover liquidated damages.
On a sub-contractor's claim in respect of a final account for work carried out in constructing an autoclave, which, so it argued, was not included in the tender price, the court ruled that, on the true construction of the contracts between the parties, the sub-contractor was entitled to additional payments.
