Patent - Infringement - Injunction - Defendant providing list of evidence relied upon - Claimant seeking list of specified documents relied upon - Whether claimant entitled to refined list of documents.
The question of whether specification of documents relied upon by the defendant should be ordered was one of fact and degree. In the instant case, the specification was to be in accordance with that offered by the defendant, and if they subsequently wished to rely on documents not specified, application to do so should be sought.
