The respondent employer's application for costs against the appellant employee was allowed as it was right for the Employment Appeal Tribunal to exercise its exceptional power under r34 of the Employment Appeal Tribunal Rules 1993 to award costs on the grounds that the two appeals were unreasonably launched and pursued.
