Joint venture - Acquisition of properties - Parties forming consortium to purchase property - Property registered in second defendant's name - Third defendant claiming beneficial interest in property - Whether third defendant having beneficial interest in property.
On the evidence, the third defendant was deemed to have a beneficial interest in the property and as a result of the first defendant's conduct, and in the light of the special features of the instant case, indemnity costs would be made against him.
