The Case

On an application by intervenors for a declaration that the shareholding and assets in a company, being the claimant in the main proceedings, formed part of the estate of one of the directors of the company, the court ruled that, on the evidence, the company was wholly under the control of the director and, accordingly, granted the declaration sought.
