The Case

In a claim for damages where the claimant, who was 68 at the date of trial, had been exposed to asbestos while working for the defendants, and subsequently developed asbestosis and diffuse plural thickening, an award of 40,000 by way of damages for pain, suffering and loss of amenity was made.
