The Case

Proportionality was a very important feature of the assessment of costs on the standard basis, particularly in relation to the fast track. In the instant case, the successful claimant's costs schedule had been clearly disproportionate to the amount of damages awarded so that the figure awarded by the judge in respect of costs had been within the range of acceptable awards.
