Court: Employment Appeal Tribunal

Lindsay J, Miss A Mackie and Mr N Willis

Representation Mr and Mrs C appeared in person.
Karon Monaghan (instructed by Commission for Racial Equality) for W.
Judgment Dates: 21 February 2001

Unfair dismissal - Determination whether dismissal fair or unfair - Appeal - Appeal limited to single point - Witness making statutory declaration that she was coerced to sign statement - Whether in circumstances decision vitiated by witness's statutory declaration.

The Case

An appeal against a decision of the employment tribunal on a single point (as to whether the decision was vitiated by one of the witnesses being, allegedly, coerced into signing a statement) failed; it was not possible to say that the decision was flawed on the single ground for which permission had been given to appeal, irrespective of other disquieting features of the decision.
