Precedents

This Precedent is a template draft report that the nominee of an IVA must prepare for the court before the creditors' meeting to vote on the IVA terms. It sets out whether the nominee believes the IVA proposal is realistic and reasonable in all the circumstances, including whether the IVA will provide a better return for creditors than bankruptcy. It sets out the main terms of the proposal and will usually recommend to the court that a meeting of creditors is called to vote on the proposed arrangement. This Precedent is produced in partnership with Paul Allen of FRP Advisory LLP.
