Biography

John is a member of the International Dispute Resolution group . He is admitted in Australia, England and Wales, Hong Kong and the DIFC Court. His principal areas of practice are energy, oil and gas, natural resources, public international law and finance.

John has acted as arbitration counsel in numerous international arbitrations and has knowledge and experience of different legal systems (including European, CIS, Middle Eastern, African and Australasian), and institutional arbitration rules such as ICC, LMAA, ACICA, GAFTA, HKIAC, and KLRCA.

John has acted as solicitor and counsel in proceedings before Australian courts, Tribunals, Investigative Commissions, and in mediations. He is also experienced in applying for injunctions in the English High Court. John advises on fraud, bribery, and corruption issues, as well as regulatory investigations.

• Acted on behalf of oil ministry of a Middle-Eastern government against a European oil lifter in a US$7 million demurrage dispute
• Acting on behalf of procurement arm of major Indian energy supplier in relation to power generating equipment design and supply disputes totaling in excess of US$250 million
• Acting on behalf of oil ministry of a Middle-Eastern government against major international petroleum supplier in a US$59 million oil supply dispute
• Acted on behalf of an Australasian professional consultancy group against Ukraine conglomerate in a US$1.7 million services agreement dispute concerning an iron ore mine
• Acted on behalf of an Australian exploration company against Malaysian/Indonesian joint venture partners in a AUD$49 million options agreement dispute concerning Madagascan coal mine and exploration rights
• Acted on behalf of a UK commodities dealer against a multinational grain importer in a £3 million grain contamination dispute
• Acted on behalf of an Australasian professional consultancy group against a Russian energy conglomerate in a €2 million services agreement dispute concerning the operation of a molybdenum ore mine
• Acted on behalf of a Turkish multinational commodities conglomerate in a €12 million shareholders dispute and financing dispute concerning petroleum coke
• Acted on behalf of a EU crane supplier against a EU shipper in a €6 million carriage dispute
• Acted on behalf of an Asian-based corporate investor against a European financier in a £3 million financing dispute
• Acted on behalf of a multi-national gold mining company against a European fabricator and other multinationals in a AUD$30 million cobalt mining plant and hydropower dispute
• Acted on behalf of a Australasian mining company against an Italian pipe fabricator in a AUD$2 million gas infrastructure dispute
Litigation
• Acting on behalf of a Middle-Eastern government in an English Court of Appeal case concerning state immunity
• Acted on behalf of a Middle-Eastern government in English High Court enforcement proceedings regarding the laws of state immunity
• Acted on behalf of oil ministry of a Middle-Eastern government in relation to the arrest and detention of an oil tanker in the UAE
• Acted on behalf of a multi-national oil/gas conglomerate against a contractor in a £2 million procurement fraud dispute and successfully obtained freezing order and judgment
• Acted on behalf of a UK-based international motor vehicle dealer in a £6 million fraud
• Acted on behalf of premier Australian and Chinese retail banks in mortgage and guarantee disputes up to AUD$25 million
• Acted on behalf of a private investment company against an Australian bank in a AUD$10 million lending dispute
• Advised a world premier oil and gas company regarding a AUD$2 million fraud by a subsidiary petroleum retail company
• Acted on behalf of an American gold mining company against joint venture partners in a AUD$8 million contentious gas and electricity supply dispute

• Provided high level training to UK companies in relation to compliance with national anti-bribery laws and anti-money laundering regulations

• Conducted FCPA due diligence investigations in China, Hong Kong and Singapore on behalf of multi-national drilling company
• Advising Middle Eastern government in relation to US$29 million bribery and corruption activities committed against the state
• Acted on behalf of a “big-four” accounting firm in a protracted HMRC and SFO criminal fraud investigation
• Advised a Middle-Eastern Government regarding compliance with UN Security Council Resolutions
• Advised a premier UK bank regarding civil diplomatic immunity and a £20 million guarantee enforceability against a member of a Middle-Eastern Royal family
• Advised a multinational energy contractor regarding multi-jurisdictional bribery and corruption conventions
• Acted on behalf of a international bio-pharmaceutical company in regulatory investigation
• Acted on behalf of premier national Australian bank in financial investigation by a corporate regulator
