1 Citation, commencement and interpretation

(1)    These Regulations may be cited as the National Health Service (Functions of Strategic Health Authorities and Primary Care Trusts and Administration Arrangements) (England) (Amendment) Regulations 2011 and shall come into force on 1st April 2011.

(2)    In these Regulations, “the principal Regulations” means the National Health Service (Functions of Strategic Health Authorities and Primary Care Trusts and Administration Arrangements) (England) Regulations 2002.

For Schedule 5 to the principal Regulations (Secretary of State's functions under section 3(1) of the National Health Service Act 2006 exercisable by Strategic Health Authorities for the purpose of securing the provision of services: specified services) substitute the following Schedule—

EXPLANATORY NOTE

EXPLANATORY NOTE (This note is not part of the Regulations)

These Regulations, which apply in relation to England, further amend the National Health Service (Functions of Strategic Health Authorities and Primary Care Trusts and Administration Arrangements) (England) Regulations 2002 (“the principal Regulations”).

Regulation 2 substitutes a new Schedule 5 to the principal Regulations. Schedule 5 lists the specialised services whose provision is to be secured in England by Strategic Health Authorities, rather than Primary Care Trusts. The revised list adds new services that Strategic Health Authorities may commission.

The new services are—

—Autologous intestinal reconstruction in adult patients (item 4)

—Complex childhood osteogenesis imperfecta (item 10)

—Insulin-resistant diabetes service (item 26)

—Lymphangioleiomyomatosis (item 29)

—Paediatric intestinal pseudo-obstructive disorders (item 40)

—Stickler syndrome diagnostic service (item 56)

—Veterans' post-traumatic stress disorder programme (item 58)

—Wolfram syndrome (item 59).

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
