1 Citation, commencement and interpretation

(1)    These Regulations may be cited as the School Support Staff Negotiating Body (Excluded Persons) Regulations 2010.

(2)    They come into force on 15th April 2010.

(3)    In these Regulations “ASCLA 2009” means the Apprenticeships, Skills, Children and Learning Act 2009.

(1)    A person who meets the condition in section 240(3)(a) of ASCLA 2009, where the person's relevant contract of employment includes terms or conditions agreed by one of the following bodies—

(a)    the Joint Negotiating Committee for Youth and Community Workers;

(b)    the Soulbury Committee;

(c)    the Joint Negotiating Committee for Local Authority Craft and Associated Employees.

(2)    In paragraph (1) “relevant contract of employment” means the contract of employment by virtue of which the person meets the condition in section 240(3)(a) of ASCLA 2009.

A person who is a participant in the Foreign Language Assistants' programme funded by the Department for Children, Schools and Families.

These Regulations provide that those persons listed in the Schedule are not included as school support staff for the purposes of section 240 of the Apprenticeships, Skills, Children and Learning Act 2009.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sector is foreseen.
