1 Title and interpretation

(1)    The title of this Order is the Education Act 2005 (Commencement No 2) (Wales) Order 2010.

(2)    In this Order “the 2005 Act” (“Deddf 2005”) means the Education Act 2005.

(3)    In this Order, unless otherwise stated, references to sections and Schedules are references to sections of and Schedules to the 2005 Act.

The following provisions of the 2005 Act come into force on 1 April 2010 in relation to Wales:

(a)    section 101 (funding of maintained schools) in so far as it relates to the provisions of Schedule 16 below,

(b)    section 117 (further amendments) in so far as it relates to Schedule 18 below,

(c)    section 123 (repeals) in so far as it relates to the provisions of Schedule 19 below,

(d)    Schedule 16, paragraphs 1 to 7 (funding of maintained schools),

(e)    Schedule 18, paragraphs 5, 7–9, 11, 13, 14 (further amendments),

(f)    in Schedule 19, in Part 4, the repeal of the School Standards and Framework Act 1998, section 45A(5) and (6), the Education Act 2002, sections 41(2), 42 and in Schedule 21, paragraphs 124(3) and 125(3), the Local Government Act 2003, in Schedule 7, paragraph 66.

This Order brings into force on 1 April 2010 section 101 of, and Schedule 16 to, the Education Act 2005 (and related consequential amendments and repeals in Schedules 18 and 19) concerning the financing of maintained schools.
