1 Title and commencement

This Order may be cited as the Disease Control (England) (Amendment) Order 2008 and comes into force on 12th May 2008.

2 Amendment of the Disease Control (England) Order 2003

2Amendment of the Disease Control (England) Order 2003

(1)    The Disease Control (England) Order 2003 is amended as follows.

(2)    In article 2, omit the definition of “veterinary surgeon”.

(3)    For paragraph (3) of article 14, substitute—

“(3)    Every animal which is moved under a specific licence shall be kept separate throughout such movement from any animal which is not being moved under that licence.”.

(4)    In article 20(1), for “the Transport of Animals (Cleansing and Disinfection) (England) Order 2003” substitute “the Transport of Animals (Cleansing and Disinfection) (England) (No 3) Order 2003”.

EXPLANATORY NOTE

EXPLANATORY NOTE (This note is not part of the Order)

This Order amends the Disease Control (England) Order 2003 (SI 2003/1729). It removes an unnecessary definition and clarifies the type of licence referred to in article 14(3) of that Order. It also replaces an incorrect reference, in article 20(1), to the Transport of Animals (Cleansing and Disinfection) (England) Order 2003 (SI 2003/255) with a reference to the Transport of Animals (Cleansing and Disinfection) (England) (No 3) Order 2003 (SI 2003/1724).

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
