These Regulations may be cited as the Cattle Identification (Amendment) Regulations 2006 and come into force on 15th June 2006.

The Cattle Identification Regulations 1998 are amended in accordance with these Regulations.

3 Amendments to regulation 2(1)

3Amendments to regulation 2(1)

(1)    Regulation 2(1) (interpretation) is amended as follows.

(2)    For the definition of “calf passport” substitute—

““calf passport” means a document in such form as may be approved by the appropriate Minister in accordance with Article 6.2 of Commission Regulation (EC) No 911/2004 (implementing Regulation (EC) No 1760/2000 of the European Parliament and of the Council as regards eartags, passports and holding registers) for the purposes of moving calves under 28 days old;”.

(3)    For the definition of “cattle passport” substitute—

““cattle passport” means a document containing the information set out in Article 6.1 of Commission Regulation (EC) No 911/2004 issued by the appropriate Minister, and includes a calf passport;”.

(4)    For the definition of “the Council Regulation” substitute—

““the Council Regulation” means Council Regulation (EC) No 1760/2000 (establishing a system for the identification and registration of bovine animals and regarding the labelling of beef products and repealing Council Regulation (EC) No 820/97);”.

(5)    For the definition of “licensed slaughterhouse” substitute—

““slaughterhouse” means a slaughterhouse—

(a)    approved or conditionally approved as such by the Food Standards Agency under Article 31(2) of Regulation (EC) No 882/2004 (of the European Parliament and of the Council on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules); or

(b)    operating as such under Article 4(5) of Regulation (EC) No 853/2004 (of the European Parliament and of the Council laying down specific hygiene rules for food of animal origin) pending such approval;”.

(6)    For the definition of “official veterinary surgeon” substitute—

““official veterinary surgeon” means an official veterinarian who is qualified in accordance with Regulation (EC) No 854/2004 of the European Parliament and of the Council (laying down specific rules for the organisation of official controls on products of animal origin intended for human consumption) to act in such a capacity and is appointed by the Food Standards Agency;”.

(7)    The definitions of “official veterinarian” and “Regulation 853/2004” (which apply in Scotland) are omitted.

The reference to the Cattle Identification Regulations 1998 in Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 shall be read as a reference to those Regulations as amended by these Regulations.

EXPLANATORY NOTE

EXPLANATORY NOTE (This note is not part of the Regulations)

These Regulations amend the Cattle Identification Regulations 1998 to replace references to Council Regulation (EC) No 820/97 with references to Council Regulation (EC) No 1760/2000 and to replace references to Commission Regulation (EC) No 2629/97 with references to Commission Regulation (EC) No 911/2004. They also update references to domestic legislation.

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
