1 Title, commencement and application

These Regulations may be cited as the Common Agricultural Policy Single Payment and Support Schemes (Reductions from Payments) (England) Regulations 2006, come into force on 26th February 2006 and apply in England only.

2 Interpretation

2Interpretation

In these Regulations—

“the Commission Regulation” means Commission Regulation (EC) No 1954/2005 amending Commission Regulation (EC) No 796/2004 laying down detailed rules for the implementation of cross-compliance, modulation and the integrated administration and control system provided for in the Council Regulation, as last amended by Commission Regulation (EC) No 2184/2005;

“the Council Regulation” means Council Regulation (EC) No 1782/2003 establishing common rules for direct support schemes under the common agricultural policy and establishing certain support schemes for farmers, as last amended by Council Regulation (EC) No 2183/2005.

3 Deductions from payments

3Deductions from payments

In accordance with Article 3 of the Commission Regulation, Article 1 of that Regulation shall not apply with regard to payments to be made in respect of the year 2005 under—

(a)    the Single Payment Scheme established in Title III of the Council Regulation, or

(b)    the aid schemes established in Chapters 1 to 7 of Title IV of the Council Regulation.

EXPLANATORY NOTE

EXPLANATORY NOTE (This note is not part of the Regulations)

These Regulations, which apply in England only, are made in accordance with Article 3 of Commission Regulation (EC) No 1954/2005 (OJ No L 314, 30.11.2005, p 10) (“the Commission Regulation”). They disapply Article 1 of the Commission Regulation with regard to payments to be made in respect of the year 2005 under the Single Payment Scheme and various other aid schemes established in Council Regulation (EC) No 1782/2003 (OJ No L 270, 21.10.2003, p 1). The effect of this is that payments under these schemes in respect of the year 2005 are to be made in accordance with Commission Regulation (EC) No 796/2004 (OJ No L 141, 30.4.2004, p 18) as if it had not been amended by Article 1 of the Commission Regulation.

A full regulatory impact assessment has not been produced for these Regulations as they have no impact on the costs of business.
