SCHEDULE  The Nursing and Midwifery Council (Fees) (Amendment) Rules 2005

The Nursing and Midwifery Council makes the following Rules in exercise of its powers conferred under articles 7(1) and (2), 33(7)(a) and 47(2) of the Nursing and Midwifery Order 2001.

The Nursing and Midwifery Council has consulted in accordance with articles 7(3) and 47(3) of that Order.

Citation and Commencement

These Rules may be cited as the Nursing and Midwifery Council (Fees) (Amendment) Rules 2005 and shall come into force on 1st January 2006.

Interpretation

In these Rules “the principal Rules” means the Nursing and Midwifery Council (Fees) Rules 2004.

Amendments to the principal Rules

In rule 3 of the principal Rules (fees)—

(a)    for the words “or evaluation” substitute “, an evaluation or a retention”;

(b)    in the table—

(i)    omit row (a);

(ii)    in the entry in column (2) of row (b), omit the words “other than one to which (a) above applies,”;

(iii)    in the entry in column (3) of row (b), for “£129” substitute “£43”;

(iv)    in the entry in column (3) of row (c), for “£162” substitute “£76”;

(v)    in the entry in column (3) of row (e), for “£129” substitute “£43”;

(vi)    in the entry in column (3) of row (f), for “£129” substitute “£43”;

(vii)    in the entry in column (2) of row (g), for the words “ (a) to” substitute “ (b),”; and

(viii)    after row (h), add row (i)—

“(i)a retention of registration£43.”

After rule 3 of the principal Rules (fees) add—

“4 Fee for retention of registration

(1)    In respect of any registration period beginning on or after 1st January 2006, the registrant shall, except as provided for in paragraph (2), pay a fee for retention of registration (as prescribed in rule 3(i)) which shall be due—

(a)    where the registration period is a first registration period (determined in accordance with rule 10 of the Nursing and Midwifery Council (Education, Registration and Registration Appeals) Rules 2004), on the first and second anniversary of the last day of the month of registration; and

(b)    where the registration period is subsequent to a first registration period (determined in accordance with rule 10 of those Rules), on the first and second anniversary of the day on which her previous registration period ended.

(2)    Where a registrant's registration period ends on 31st December 2005 a fee for retention of registration will not be due during the registration period ending 31st December 2008.”.
