In this Order “the Department” means the Department for Social Development in Northern Ireland and “the Child Benefit Office” means the Child Benefit Office of the executive Agency known as the Social Security Agency, within the Department.

(1) With effect from 1st April 2003 there shall be transferred to Her Majesty's Home Civil Service the persons specified in paragraph (2).
(2) The persons specified are those persons employed wholly in the Child Benefit Office, not above the grade of deputy principal.
Here “persons employed wholly in the Child Benefit Office”—
(a) includes persons so employed who are on leave or secondment on 31st March; but
(b) excludes those persons who are listed on a Northern Ireland Civil Service promotion list but have not been promoted by that date.
(3) Where a person is transferred to Her Majesty's Home Civil Service under this Article, his period of employment in the Northern Ireland Civil Service shall count as a period of continuous employment in Her Majesty's Home Civil Service for the purposes of the Employment Rights (Northern Ireland) Order 1996.

This Order transfers from the Department for Social Development in Northern Ireland (“the Department”) to the Inland Revenue the staff of the Child Benefit Office of the Social Security Agency, an executive Agency of the Department. This is in consequence of the transfer under Part 2 of the Tax Credits Act 2002 (c 21) of functions relating to child benefit and guardian's allowance on 1st April 2003.
