(1)    This Order may be cited as the New Roads and Street Works Act 1991 (Commencement No 7) (England) Order 2002.

(2)    This Order applies as respects England only.

With the exception of subsection (1)(c), section 79 of the New Roads and Street Works Act 1991 (records of location of apparatus) shall come into force, as respects England, on 1st May 2003.

EXPLANATORY NOTE

EXPLANATORY NOTE (This note is not part of the Order)

This Order brings into force on 1st May 2003 in England the provisions of section 79 of the New Roads and Street Works Act 1991, except subsection (1)(c). Section 79 of the Act imposes a duty on undertakers to keep records of the location of apparatus in streets in certain circumstances. Subsection (1)(c) imposes the duty when the undertaker is informed of the apparatus' location under section 80 of the Act, which is not yet in force.
