1 Title, commencement and extent

These Regulations may be cited as the Plant Protection Products (Amendment) (No 2) Regulations 2001, extend to England and Wales, and come into force on 1st August 2001.

2 Amendment of the Plant Protection Products Regulations 1995

2Amendment of the Plant Protection Products Regulations 1995

In so far as they extend to England and Wales, the Plant Protection Products Regulations 1995 shall be amended by substituting for the definition of “the Directive” in regulation 2(1), the following definition—

““the Directive” means Council Directive 91/414/EEC concerning the placing of plant protection products on the market, as amended by—

(a)    Commission Directive 93/71/EEC;

(b)    Commission Directive 94/37/EC;

(c)    Commission Directive 94/79/EC;

(d)    Commission Directive 95/35/EC;

(e)    Commission Directive 95/36/EC;

(f)    Commission Directive 96/12/EC;

(g)    Commission Directive 96/46/EC;

(h)    Commission Directive 96/68/EC;

(i)    Council Directive 97/57/EC;

(j)    Commission Directive 97/73/EC;

(k)    Commission Directive 98/47/EC;

(l)    Commission Directive 1999/1/EC;

(m)    Commission Directive 1999/73/EC;

(n)    Commission Directive 1999/80/EC;

(o)    Commission Directive 2000/10/EC;

(p)    Commission Directive 2000/49/EC;

(q)    Commission Directive 2000/50/EC;

(r)    Commission Directive 2000/66/EC;

(s)    Commission Directive 2000/67/EC;

(t)    Commission Directive 2000/68/EC;

(u)    Commission Directive 2001/28/EC;”.

EXPLANATORY NOTE

EXPLANATORY NOTE (This note is not part of the Regulations)

These Regulations, which extend to England and Wales, further amend the Plant Protection Products Regulations 1995 (SI 1995/887) which implement in Great Britain Council Directive 91/414/EEC concerning the placing of plant protection products on the market (OJ No L230, 19.8.91, p 1 as read with OJ No L170, 25.6.92, p 40).

The Regulations amend the definition of “the Directive” in SI 1995/887 so as to implement—

— Commission Directive 2000/66/EC (OJ No L276, 28.10.2000, p 35)

— Commission Directive 2000/67/EC (OJ No L276, 28.10.2000, p 38)

— Commission Directive 2000/68/EC (OJ No L276, 28.10.2000, p 41)

— Commission Directive 2001/28/EC (OJ No L113, 24.4.2001, p 5)

which add triasulfuron, esfenvalerate, bentazone and fenhexamid respectively to Annex I to the Directive.

The Regulations revoke the Plant Protection Products Regulations 2001 (SI 2001/1112) which are either spent or consolidated in these Regulations.
