These Regulations may be cited as the Education (Teachers' Qualifications and Health Standards) (England) (Amendment) Regulations 2001 and shall come into force on 26th April 2001.

The Education (Teachers' Qualifications and Health Standards) (England) Regulations 1999 shall be amended as follows:

(a)    in paragraph 4(1) of Schedule 2, the substitution for sub-paragraphs (a) and (b) of “he has successfully completed a programme of professional training for teachers in any country outside the United Kingdom and which is recognised as such a programme of training by the competent authority in that country,”;

(b)    in paragraph 4(2) of Schedule 2, the substitution for “two” of “four”;

(c)    in paragraph 6(4) of Schedule 2, the substitution for “the training” of “any training”;

(d)    for paragraph 7 of Schedule 2 the substitution of the following paragraph—

(1)    Subject to sub-paragraph (2), the length of any proposed period of training shall be appropriate to the person's need for practical teaching experience and training and, in the case of a first recommendation where the person will be employed full-time it shall be not less than three months and not more than one year.

(2)    In the case of a person to whom paragraph 6(3)(e)(ii) applies no minimum period of training is required.”;

(e)    in paragraph 7(2)(a) of Schedule 3 “either” shall be deleted;

(f)    in paragraph 7(2)(a)(i) of Schedule 3 the substitution for “the training” of “any training”;

(g)    in paragraph 7(2)(a)(ii) of Schedule 3 after “paragraph (b);” there shall be inserted “or”; and

(h)    in paragraph 7(2)(a) of Schedule 3 after sub-paragraph (ii) there shall be added the following sub-paragraph—

“(iii)    is a graduate teacher to whom paragraph 6(3)(e)(ii) of Schedule 2 applies;”.

EXPLANATORY NOTE

EXPLANATORY NOTE (This note is not part of the Regulations)

These Regulations amend the Education (Teachers' Qualifications and Health Standards) (England) Regulations 1999 (SI 1999/2166).

Paragraph 4 of Schedule 2 is amended to increase the period for which overseas trained teachers may be employed as temporary teachers from two years to four years and the restriction on the length of time at a particular school has been removed.

Paragraph 7 of Schedule 2 is amended to remove the requirement to complete a minimum training period or period of service for overseas trained teachers who are seeking to achieve qualified teacher status through the graduate teacher programme who are assessed as meeting the specified standards for the award.
