These Regulations may be cited as the Dual-Use and Related Goods (Export Control) (Amendment No 3) Regulations 1999 and shall come into force on 26th July 1999.

(1)    The following amendment shall be made in Schedule 2 to the Dual-Use and Related Goods (Export Control) Regulations 1996.

(2)    In Category 1—Materials, Chemicals, Microorganisms & Toxins,

(a)    entry 1C950a shall be replaced by the following:—

“a    Mixtures containing one or more of the chemicals specified in entries 1C350.1, .3, .5, .11, .12, .13, .17, .18, .21, .22, .26, .27, .28, .31, .32, .33, .34, .35, .36 and .54 of “Annex I” where the chemical constitutes more than 10% by weight of the mixture;”, and

(b)    in entry 1C950b, the words “mixtures containing any of the chemicals” shall be replaced by the words “mixtures containing one or more of the chemicals”.

EXPLANATORY NOTE

EXPLANATORY NOTE (This note is not part of the Regulations)

These Regulations amend Schedule 2 of the Dual-Use and Related Goods (Export Control) Regulations 1996 made in implementation of and pursuant to Council Regulations (EC) No 3381/94 on the control of exports of dual-use goods (OJ No L367 31.12.1994, p1) by

—adding the chemical specified in entry 1C350.5 of Annex 1 to Council Decision 94/942 CFSP (OJ No L367 31.12.1994, p8) as amended by Council Decision No. 99/193/CFSP (OJ No L73,19.3.1999, p1) to the list of chemicals specified in entry 1C950a, a mixture of which is prohibited to be exported if it contains more than the prescribed weight;

—correcting an error in entry 1C950b.

These Regulations do not implement any new Community obligation but make an amendment to a pre-existing national control which is permitted to remain in force by Article 5 of the EC Regulation as a matter of national discretion.
