UPDATING
EF&P is updated on a rolling basis throughout the year in response to changes in practice and the law. As a minimum, this means 1 release per month. A release may include:
- A complete rewrite of material in a single title, including commentary and precedents
- Amended precedents only
- Information notes highlighting forthcoming changes
The team review the material across the titles, and new developments in the law and practice are reflected in title rewrites or selective updating.
EF&P is contributed by specialist authors; therefore all new legislation cannot be incorporated immediately.
Date stamps
Titles and precedents state when (and, where practical, how) they have been amended. Italic text under precedent headings, and bold text at the end of title overviews, show the date and nature of amendments. The dates on which titles were last reissued and amended are also in the list of titles and authors below.
Terms used in date stamps mean the following:

Whole titles
Ecclesiastical Law (including Religious Gifts) May 2013, vol 14
The title ECCLESIASTICAL LAW (INCLUDING RELIGIOUS GIFTS) (2013 Reissue) has been contributed by Lee Coley and Ian Blaney of Lee Bolton Monier-Williams. The firm’s ecclesiastical experience is nationally recognised, with The Legal 500 (2012 edition) highlighting Lee Bolton Monier-Williams as being ‘highly regarded in the market’. With over 150 years of experience in the sector, the firm has established a reputation for excellence amongst a number of faith groups in addition to the Anglican church.
The title has been fully revised and updated to take account of legislative changes and amendments, and also revisions to Land Registry forms and practice. New legislation includes the Charities Act 2011, the Ecclesiastical Offices (Terms of Service) Measure 2009, and the Mission and Pastoral Measure 2011.
The title contains well over a hundred precedents dealing with such wide-ranging matters as Church government, patronage and presentation, contracts of employment, and forms relating to the property of the Church of England and other Christian denominations. There is also commentary and precedents relating to Church of England burial and burial grounds, and precedents and commentary relating to church property. In addition, there is a substantial section on testamentary gifts for religious purposes covering gifts to the Church of England, the Roman Catholic Church and other denominations.
Energy (Renewables) May 2013, vol 14
The title ENERGY (RENEWABLES) (2013 Reissue) has been contributed by Brian Wake and Catherine Burke.
Brian Wake is a consultant with Dyne Solicitors Ltd and DTM Legal in Chester, where he advises on renewable energy, minerals, waste and environmental issues. He lectures widely on these topics. Brian Wake is a member of the United Kingdom Environmental Law Association and a member of its North West Committee.
Catherine Burke is a partner with Freeth Cartwright LLP in Birmingham where she heads up the renewable energy team. She has a wealth of experience in renewable energy projects, from solar to wind power.
The title is a new title for 2013 and is offered as an aid to practitioners who find themselves involved in a renewable energy scheme, whether for landowners or operators/developers. The title covers (inter alia) wind, solar, biomass and small hydro schemes, which are the types of renewable energy topics most practitioners are likely to encounter in their day to day work.
Practitioners employed within the renewable energy industry, or in private practice and acting for companies in the sector, will inevitably have their own sources of law and their own bank of precedents. It is not intended that this title should displace any of those, but rather that the commentary should act as a reminder of the main sources of treaties, legislation and guidance affecting renewable energy developments, and that the precedents may offer alternatives to such practitioners’ own precedent banks.
The precedents represent a ‘middle of the road’ position which will give advisers to landowners access to documents that provide a base level of protection for their clients, whilst giving developers and funders sufficient rights and protection for the significant investment which is often required. It should be borne in mind that this title is not a substitute for taking appropriate expert advice from eg surveyors or accountants with experience in the particular project concerned, and the precedents should be not be regarded as definitive in any particular aspect.
The precedents include explanatory notes, checklists, heads of terms, option agreements, deeds regarding mineral rights, a conditional contract for the grant of a lease of a site for a windfarm, a lease of a substation site, an operating and maintenance agreement, a contract for the supply of raw feedstock for biomass projects, and a section 106 agreement for a windfarm project.

Employment vol 14(1)A
The commentary and precedents have been updated in view of the Court of Appeal’s ruling in Bates van Winkelhof v Clyde & Co LLP, 2012, on the territorial scope of employment law.
Philip Thornton, Professional Support Lawyer, has updated the optional payment in lieu of notice (‘PILON’) clause for a service agreement or employment contract following the Supreme Court’s recent decision in Geys v Société Générale, London Branch, 2012. To take account of this decision, two new precedent letters are included for an employer to give the required notification when exercising the right to make a payment in lieu of notice as a lump sum or in instalments. Detailed drafting notes accompany these new precedents.
As from 8 March 2013, the Parental Leave (EU Directive) Regulations 2013, SI 2013/283 increase a qualifying employee’s entitlement to unpaid parental leave from 13 to 18 weeks and extend the right to request flexible working to agency workers who are returning from a period of parental leave. The commentary and policies on parental leave and flexible working have been updated accordingly.
The other commentary and precedents on family leave have been amended in view of the new rates of statutory maternity, paternity and adoption pay and additional statutory paternity pay as from 7 April 2013.
Financial Services vol 16(3)A–B
An information note is included concerning the Financial Services Act 2012, which introduces changes to the regulation of financial services in the United Kingdom from 1 April 2013. As from this ‘legal cutover’ date, the Financial Services Authority is replaced by two new regulators: the Prudential Regulation Authority (the prudential regulator) and the Financial Conduct Authority (the conduct regulator). A table is also included setting out a complete list of the statutory amendments made by the Financial Services Act 2012.

The prescribed Land Registry Form JO ‘Land Registry Trust Information’ is included. This is a new voluntary form, which provides an alternative means for joint owners to declare their interests, or to give details of an existing separate declaration of trust, when they acquire the property.
The Land Registry standard restrictions applicable to charities have been updated to conform with the Charities Act 2011.
