The Case

Judicial review Application for judicial review. The defendant local authority refused to grant the claimant solicitor a new lease for her office premises as her firm had brought a large number of personal injury claims against the authority. The Administrative Court allowed the claimant's application for judicial review, holding that there was a sufficient public law element or connection to render the decision amenable to judicial review on the ground of abuse of power and that the authority's decision had been fundamentally tainted by illegality.
