The Case
Personal injuries Extent of injury. The Queen's Bench Division, in determining the claimant's personal injury claim against the defendant in respect of the index accident, held that the claimant had essentially made a full recovery from her shoulder injury by the time of the second accident and that the breakdowns in her mental health following the second accident were not referable to the index accident.
