The Case
Holiday Contract. The Court of Appeal, Civil Division, in allowing the claimant's appeal, held that, on the facts of the instant case, the defendant travel retailer had sold the claimant a package holiday within the meaning of the Package Travel, Package Holidays and Package Tours Regulations 1992, SI1992-3288, where the claimant had seen the holiday advertised on Teletext and made the booking at the last minute and where the flights and accommodation had been booked with different providers through the defendant.
