The Case

European Union Freedom of movement. The Court of Justice of the European Union gave a preliminary ruling concerning the interpretation of art12 of Council Regulation (EEC) 1612-68 (on freedom of movement for workers within the Community, as amended by Council Regulation (EEC) 2434-92) (Regulation 1612-68), and of Parliament and Council Directive (EC) 2004-38 (on the right of citizens of the Union and their family members to move and reside freely within the territory of the member states, amending Regulation 1612-68), made in the course of proceedings between the claimant and the first defendant local authority and the Secretary of State for the Home Department concerning the rejection by that local authority of the claimant's application for housing assistance.
