The Case
European Community Environment. The Court of First Instance of the European Communities allowed Estonia's application for annulment of the European Commission's decision calling for a reduction of 47.8% compared with the emission allowances which the applicant was proposing to issue pursuant to Parliament and Council Directive (EC) 2003-87 (establishing a scheme for greenhouse gas emission allowance trading within the Community).
