Where the respondent contended that the employment tribunal had erred in upholding the employee's claims of sexual harassment, contrary to s4A(1)(b) of the on the bases, inter alia, that the tribunal had misdirected itself in relation to the standard of proof and had wrongly treated the acts complained of as a continuing act for the purposes of s76(6)(b) of the 1975 Act, the Employment Tribunal held that the tribunal had not fallen into error. Accordingly, the respondent's appeal was dismissed.
