The Case

The respondent's Interim Orders Panel had been entitled, on the evidence, to suspend the doctor while he was referred to it's Fitness to Practise Panel, following his professional performance assessment. The doctor's argument for lifting the suspension, under s41A(10)(a) of the was rejected as although it was a matter for ventilation before the Fitness to Practise Panel, it was immaterial to the Interim Orders Panel, whose decision had been based on whether the suspension was in the public interest.
