The Case
Trust and trustee Bare trust. Where a company was formed and the shares were divided equally between four shareholders, including the claimants and the first defendant, following which the claimants had transferred their shares to the first defendant, it was held that the shares had been put into the first defendant's name as a nominee and for tax purposes, and the shares had been held for the claimants on trust.
