The Case
A minimum term of 16 years less 5 months spent in custody on remand was set on a reference under para6 of Sch22 to the in respect of an offender who had been involved in the racist killing of a white teenager. Although he had not wielded the knife that had caused death, and he had not intended to kill, he had to have known that death was a highly likely consequence of what they planned to do and that one of the co-accused was carrying a knife and intended to use it.
