The Case
Family proceedings Family proceedings court. Where, at a fact finding hearing following allegations of abuse against the only child of the mother and father, the judge found that mother had caused head injuries to the child, but could not exonerate either the mother or father with regard to a further injury caused to the child, the judge's findings had in no way been illogical. The judge had not intended that the mother and father were equally responsible for the injuries caused to A, and it was manifest that, of the two, the mother was more likely to have inflicted the injury.
