The Case
Sentence - Mandatory life sentence. Where the Secretary of State for the Home Department had notified the offender of the minimum term to be served in relation to a life sentence for murder in concurrence with the views expressed by the trial judge and the then Lord Chief Justice, both of whom had explicitly allowed the offender credit for his plea of guilty, and where the offender had subsequently been unsuccessful in an application to vacate his guilty plea, the offender had forfeited that credit on a subsequent application for a review of the minimum term made under to the Criminal Justice act 2003.
