Unfair dismissal Determination whether dismissal fair or unfair. An employment tribunal had misdirected itself on the authorities in reaching the conclusion that an employee had left his employment by mutual consent. The tribunal had plainly misdirected itself on the authorities, and that error had equally plainly led it to the wrong conclusion.
