The Case

Sentence Imprisonment. The defendant's appeal against a sentence of 12 months' imprisonment concurrent on one count of unlawful wounding and one count of assault occasioning actual bodily harm, relying on, inter alia, his previous good character and the conclusions of a pre-sentence report that he posed a low risk of reoffending, the appeal would be dismissed. In all the circumstances, the sentence passed by the judge already reflected the mitigating circumstances available to the defendant. The sentence was not a heavy one for a case of the instant character. The offence certainly did not justify a lesser sentence than the judge had imposed.
